Guidance: charities with a connection to a non-charity
The Charity Commission has produced guidance (March 2019) for trustees of charities with a connection to a non-charity.
The guidance is aimed at managing connections in line with legal trustee duties, the charities’ best interests and those of its beneficiaries. In partnering with non-charities, charities must refrain from furthering non-charitable purposes. They must ensure that any benefit to the non-charity is incidental.
The guidance outlines:
- Trustees’ duties with regard to reviewing and managing risk in respect of connections.
- Identifying and addressing conflicts of interest when working with non-charities.
- What to consider when deciding whether to work with or continue to work with a non-charity.
Managing Trustees are advised to note that for the purposes of the guidance, the word ‘should,’ refers to best practice, whereas ‘must,’ refers to a legal requirement.
